How ItWorks Technical Business Solutions collects, uses, and protects your information - including information related to our SMS text messaging program.

1. Who we are

ItWorks Technical Business Solutions ("ItWorks," "we," "us," or "our") is a two-partner technology consultancy operating in Alabama, United States. This Privacy Policy applies to itworksdev.com (the "Site"), our contact and demo forms, our SMS text messaging program, and the software platforms we build, host, and operate on behalf of our clients.

Where we operate a platform for a client, the people who sign in to it are usually that client's own staff or contractors rather than our customers. Text messages sent to them to get them into the software are sent by ItWorks as the operator of that platform, and are covered by this policy.

By using the Site or opting in to receive text messages from us, you agree to the practices described in this policy.

2. Information we collect

  • Information you give us. Your name, business name, email address, mobile phone number, preferred contact time, and the contents of any message you submit through our contact form, by email, by phone, or by text message.
  • SMS consent records. When you opt in to text messages, we record the phone number, the date and time of opt-in, the method of opt-in, and the wording of the consent language shown to you. Where an administrator records consent on behalf of a platform user, we also record which administrator did so.
  • Account information. If you create or are issued an account on the Site, we store your login identifier and a securely hashed password.
  • Demo and chat input. Text you enter into our interactive AI demo is sent to our AI provider to generate a response. Do not enter confidential, sensitive, or personally identifiable information into the demo.
  • Technical information. IP address, browser type, pages visited, and timestamps, collected automatically in server logs for security, rate limiting, and diagnostics.

3. How we use your information

  • To respond to inquiries and provide the consulting services you request.
  • To send customer care and conversational replies by email, phone, or SMS.
  • To send appointment reminders and service notifications.
  • To send account alerts and one-time passcodes for two-factor authentication.
  • To operate, secure, troubleshoot, and improve the Site.
  • To comply with legal, tax, and regulatory obligations.

4. SMS text messaging program

ItWorks sends text messages using Twilio as our messaging provider. Our program is limited to the following message types:

  • Customer care / conversational: replies to questions and requests you send us.
  • Appointment reminders and service notifications: scheduling confirmations, changes, and project or service updates.
  • Account alerts and two-factor authentication: security notices and one-time passcodes.
  • Platform sign-in: one-time sign-in codes and single-use sign-in links sent to authorised users of software we operate for a client, so that they can get into the application. These are sent only when a sign-in is requested.

We do not send marketing or promotional text messages.

Consent

You opt in by providing your mobile number and affirmatively agreeing to receive text messages - for example, by checking the SMS consent box on our contact form, by requesting a text reply, or by texting us first. Consent to receive text messages is not a condition of purchasing any product or service from us.

Consent for users of a platform we operate

Users of software we operate for a client are enrolled by an administrator at that client rather than through this website. Before a mobile number is added to an account, the administrator confirms with that person that they agree to receive sign-in codes and account notifications at it. The administrator then records how the agreement was given - verbally, on a signed form, or because the person texted us first - along with the date and their own name.

The system will not send anything to a number that has no consent recorded against it, and the record is cleared if the number is later changed, so consent has to be confirmed again for the new handset. Users may opt out at any time by replying STOP, as described below.

Message frequency

Message frequency varies and depends on your interactions with us. Conversational and appointment-related messages are sent as needed; authentication messages are sent when you request or trigger them.

Cost

Message and data rates may apply. ItWorks does not charge for text messages, but your mobile carrier's standard rates apply.

Opting out and getting help

Reply STOP to any message to stop receiving texts from us. You will receive a single confirmation message and no further messages, unless you opt in again. Reply HELP for assistance, or contact us at Scott@itworksdev.com or 251-753-8019.

Carriers and delivery

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless service provider and is not guaranteed.

5. Mobile information and third parties

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties. Information you share with us may be disclosed to subcontractors only in support of the services we provide to you - for example, to our messaging provider so that a message can be delivered to your handset.

6. How we share other information

We do not sell, rent, or trade your personal information. We share information only with:

  • Service providers who process data on our behalf, including Twilio (SMS delivery), Microsoft Azure (hosting and AI services), and Google (email delivery for contact form notifications).
  • Legal and safety recipients when required by law, subpoena, or to protect the rights, property, or safety of ItWorks, our clients, or others.
  • A successor entity in connection with a merger, acquisition, or sale of assets, subject to this policy.

Service providers are contractually limited to using your information only to perform services for us.

7. Cookies and similar technologies

The Site uses only the cookies necessary to operate it, such as session and authentication cookies and anti-forgery tokens. We do not use advertising or cross-site tracking cookies. You can block cookies in your browser, but parts of the Site may stop working.

8. Data retention

We keep contact submissions and project correspondence for as long as needed to serve you and to meet legal and accounting requirements. SMS consent and opt-out records are retained for at least four years, as required for messaging compliance. Server logs are retained for a limited period for security and diagnostics.

9. Security

We use industry-standard safeguards including encryption in transit (HTTPS/TLS), hashed credentials, access controls, and secrets stored outside of source control. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

10. Your choices and rights

  • Reply STOP to opt out of text messages at any time.
  • Ask us to access, correct, or delete the personal information we hold about you.
  • Ask us to stop contacting you by email or phone.
  • Residents of states with applicable privacy laws may have additional rights, including the right to know what information we collect and to opt out of any sale or sharing of personal information. We do not sell or share personal information.

11. Children's privacy

The Site and our services are intended for businesses and adults. We do not knowingly collect personal information from anyone under 13. If you believe a child has provided us information, contact us and we will delete it.

12. Changes to this policy

We may update this Privacy Policy from time to time. The "Last updated" date above reflects the most recent revision. Material changes affecting our SMS program will be posted here before they take effect.
